These Terms govern your use of the app, including any features, services, or content provided through the app.

By using Quantise, you confirm that you have read, understood, and agreed to these Terms.

2. Eligibility

To use Quantise, you must meet the following criteria:

2.1. Minimum Age Requirement

• For users located in the United States or other jurisdictions where the minimum digital consent age is 13, you must confirm that you are at least 13 years old.
• For users located in the European Union or European Economic Area (EEA), you confirm that you are at least 16 years old, or the minimum age of digital consent in your country if lower.

2.2. Legal Capacity

You affirm that you have the legal capacity to agree to these Terms in your jurisdiction.

2.3. Account Restrictions

Users who have had their accounts terminated or suspended by Quantise are prohibited from accessing the platform.

3. User Accounts

3.1. Account Creation and Access

To use certain features of Quantise, you may be required to create an account. When you register, you agree to provide accurate and up-to-date information, including your email address or other identifiers required for registration. You are solely responsible for maintaining the confidentiality of your login credentials.

3.2. Account Termination

Quantise reserves the right to terminate or suspend your account at any time without prior notice if:

• You violate these Terms.
• Your actions cause harm to the platform, its users, or third parties.
• Required by law or applicable regulations.

4. User Conduct

4.1. General Behavior

You agree to use Quantise in a lawful, respectful, and responsible manner. You will not engage in any conduct that disrupts, interferes with, or damages the functionality of the app, or harms other users.

4.2. Prohibited Uses

You agree not to use the service for any unlawful, harmful, or malicious activities, including but not limited to:

• Spamming: Sending unsolicited communications, including invitations or friend requests.
• Malicious Content: Posting or transmitting harmful, offensive, or inappropriate content.
• Impersonation: Pretending to be another user or entity, or misrepresenting your affiliation with any individual or organization.
• Violate intellectual property rights: Do not infringe on the copyrights, trademarks, patents, or other intellectual property rights of others.
• Interfering with the Platform: Engaging in activities that disrupt or interfere with the proper functioning of the service, such as introducing viruses, malware, or other malicious code.

Quantise reserves the right to suspend or terminate accounts involved in any prohibited activities.

5. User-Submitted Content

5.1. Ownership and License

You retain ownership of all content you submit to Quantise, including but not limited to questions, answers, feedback, comments, and any other materials. By submitting content to Quantise, you grant Quantise a worldwide, non-exclusive, royalty-free, transferable license to use, modify, reproduce, distribute, display, and perform the content for the purpose of operating and promoting the app.

5.2. Content Guidelines

You agree that the content you submit must comply with all applicable laws and regulations and must not violate the rights of any third parties, including but not limited to copyright, trademark, or privacy rights. You are responsible for ensuring that your content is appropriate, accurate, and does not infringe upon the intellectual property rights of others.

5.3. Approval and Review

Submitted content may be subject to review and approval by Quantise or other users before it is published or used. Quantise reserves the right to reject or modify any content that it deems inappropriate, offensive, or in violation of these Terms of Service. This includes content generated by AI.

5.4. AI-Generated Content

If you submit content for AI processing (e.g., question generation or content refinement), you acknowledge that the AI may generate new or modified content based on your input. Quantise may use AI-generated content in various languages or formats and reserves the right to accept, modify, or reject such content as needed.

6. Intellectual Property

All content, features, and functionality of Quantise, including but not limited to the app's design, logos, branding, text, graphics, audio, video, software, and other materials (collectively, the "Content"), are owned by or licensed to Quantise and are protected by intellectual property laws, including copyright, trademark, and other proprietary rights. You acknowledge that the app's content, including the underlying code, is the intellectual property of Quantise and is protected by applicable intellectual property laws. You may not use, copy, modify, or distribute any part of the app's content without express permission.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy for information on how we collect, use, and protect your personal data when you use the app.

7.1. Data Collection and Usage

By using the app, you acknowledge and agree that Quantise may collect, store, and process personal data in accordance with its Privacy Policy. This includes, but is not limited to:

• Information provided during account registration.
• Data generated during gameplay or interactions within the app.
• Content or questions submitted for AI-based question generation.

7.2. Consent for Processing

For users in jurisdictions requiring explicit consent for data processing, including but not limited to the European Union, you agree to provide such consent when you register for or use the app. If you are under the minimum legal age for data processing in your region, parental or guardian consent may be required.

7.3. User Responsibilities

You are responsible for ensuring that any data or content you submit complies with all applicable laws, including data protection regulations. Do not submit sensitive or confidential personal information unless specifically requested by the app's functionality.

7.4. Security

Quantise implements reasonable security measures to protect your data. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Limitations of Liability

To the fullest extent permitted by applicable law:

8.1. No Warranty

Quantise is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the app, its content, or any services offered. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the app will meet your requirements or operate without interruption or error.

8.2. Limitation on Damages

In no event shall Quantise, its affiliates, partners, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, loss of data, profits, revenue, or business opportunities, or damages resulting from unauthorized access, use, or alterations of your transmissions or data.

8.3. Third-Party Interactions

Quantise is not liable for any interactions, agreements, or disputes between you and other users or third parties you interact with through the app.

8.4. Jurisdiction-Specific Limitations

Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities. In such cases, the limitations and exclusions set forth in this section may not apply to you to the extent prohibited by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Quantise, its affiliates, licensors, partners, and service providers, along with their respective officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees and legal costs) arising out of or in any way connected with:

• Your Use of the App: Your access to or use of the app in violation of these Terms, or any breach of applicable laws, rules, or regulations in connection with your use of the app.
• User-Submitted Content: Content you submit, post, or otherwise make available through the app, including but not limited to any claims of intellectual property infringement, defamation, or other violations of third-party rights.
• Violations of Rights or Harm to Others: Your violation of any rights of another person or entity, including intellectual property rights, privacy rights, or contractual obligations, or your conduct that causes harm to others or creates a legal liability for Quantise.

Quantise reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate fully with us in asserting available defenses or reaching a settlement. The limitations set forth in "Limitations of Liability" do not limit your indemnification obligations under this Section.

10. Termination

10.1. Termination by You

You may stop using the app at any time by deleting your account and discontinuing access to the app. To delete your account, you may follow the process outlined in the app settings or contact our support team.

10.2. Termination by Quantise

We reserve the right to suspend or terminate your access to the app, in whole or in part, at our sole discretion, without prior notice, if:

• You breach these Terms or any applicable laws or regulations.
• Your actions disrupt the functionality of the app or harm other users.
• We discontinue the app or its specific services.
• There are technical, security, or legal concerns requiring action.

10.3. Effect of Termination

Upon termination of your account or access to the app:

• You will lose all access to the app and its content, including any stored data associated with your account.
• Any licenses or rights granted to you under these Terms will immediately cease.

10.4. Survival of Provisions

The following provisions will survive termination of these Terms: Intellectual Property, Privacy, Limitations of Liability, Indemnification, and Governing Law and Dispute Resolution.

10.5. Reinstatement

Termination or suspension of your account does not preclude you from creating a new account unless explicitly prohibited by Quantise.

11. Changes to the Terms

11.1. Right to Modify

We reserve the right to update, revise, or modify these Terms at any time at our sole discretion. Changes may be made to reflect updates to the app, comply with legal requirements, or for any other operational or business purpose.

11.2. Notification of Changes

If we make significant changes to these Terms, we will provide notice through one or more of the following methods:

• Posting the revised Terms on our app or website.
• Sending an in-app notification or email to users, where applicable.

The updated Terms will include the "Effective Date" to indicate when they take effect.

11.3. Acceptance of Changes

By continuing to use the app after the updated Terms are posted or notified, you agree to be bound by the revised Terms. If you do not agree to the changes, you must stop using the app and may delete your account.

11.4. Review of Terms

We encourage you to periodically review these Terms to stay informed of any updates or modifications.

12. Governing Law and Dispute Resolution

12.1. Governing Law

These Terms, along with your use of the app, are governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles.

12.2. Venue and Jurisdiction

If any disputes or claims arise out of or relate to these Terms or the use of the app, they shall be resolved exclusively in the courts of the Republic of Türkiye. You agree to submit to the personal jurisdiction of these courts and waive any objection to jurisdiction or venue based on inconvenient forum or any other grounds.

12.3. Informal Dispute Resolution

Before initiating any formal legal action, you agree to attempt to resolve the dispute informally by contacting us at [email protected]. Both parties agree to make good-faith efforts to resolve the issue within 30 days of initial contact.

12.4. Class Action Waiver

You agree that any disputes or claims must be resolved individually and not as part of any class, collective, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

12.5. Exception for Injunctive Relief

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent or stop unauthorized use of intellectual property or confidential information.
